Terms of Service.

01

Who we are and what these terms cover

These Terms of Service ("Terms") are an agreement between you and Quick Consign LLC, doing business as Quick Consign ("QC", "we", "us"). They cover your use of quickconsigncards.com, the consignor portal, our emails and text messages, and our chat assistant (together, the "Services").

If you consign items with us, you also signed our Membership Agreement. The Membership Agreement controls the consignment itself (fees, payout rates, listing rules, holds, returns). If these Terms and the Membership Agreement conflict about a consignment, the Membership Agreement wins.

02

Eligibility and your account

  • You must be at least 18 years old and able to enter a binding contract. We serve consignors in the United States and internationally; international consignors are paid by international wire, and any bank, wire or currency-conversion fees on their side are their responsibility.
  • Give us accurate, current information (name, address, contact and payout details) and keep it up to date in the portal. Payouts sent to details you provided are your responsibility.
  • Keep your login private. You are responsible for activity on your account. Tell us right away at support@quickconsigncards.com if you think it was accessed without permission.
  • If you share access with someone else (for example a joint or family account), you are responsible for what they do.
03

Consigning items

When you send us items, you give us the exclusive right to sell them on eBay (auction or fixed price) as described in the Membership Agreement. You confirm you own each item, it is authentic, and you have the right to sell it.

Fees, payout percentages, special-service prices and turnaround times are set out in the Membership Agreement and on our website.

We may refuse, end or remove any listing we believe is counterfeit, altered, misdescribed, against eBay rules, or involved in shill bidding.

04

Your items in our care

We take reasonable care of your items from the time we receive them until they are sold, returned, or otherwise handled under the Membership Agreement. If an item is lost, stolen or damaged while in our possession, including while moving between our Florida or Vermont drop-off points and Pennsylvania, our responsibility is limited to the item's fair market value, based on recent comparable eBay sales at the time of the loss, less the fees we would have earned had it sold.

We are not responsible for items before we receive them, including loss or damage in the mail.

05

Payouts and the portal

  • Payouts are made on the schedule in the Membership Agreement to the payout method on file, less fees, special-service charges and any amounts owed (for example returns, chargebacks or non-paying-buyer adjustments).
  • Balances and totals shown in the portal are estimates for your convenience. Your weekly payout report is the official record of what you are paid. If the portal and the payout report differ, the payout report controls.
  • eBay may hold funds for some items (for example during authentication). We pay held items after the funds are released to us.
  • We may hold or reverse a payment, or offset it against future payouts, to cover returns, chargebacks, fraud, or items later found to be stolen, altered or inauthentic, as described in the Membership Agreement.
06

Emails and text messages

We send account and transaction messages by email, such as submission updates, payout reports and security notices. These are part of the Services.

If you choose text messages in your portal settings, we will text you about your submissions and account. Message frequency varies. Message and data rates may apply. Reply STOP to stop texts at any time, or HELP for help. Consent to texts is not a condition of using the Services. Carriers are not liable for delayed or undelivered messages.

07

Our chat assistant

The chat on our website and portal is an automated AI assistant, not a person. It can make mistakes. It does not change your account, fees or payouts — for anything that matters, rely on your payout report and the Membership Agreement, or contact our team. Chats may be stored and reviewed to help us support you and improve the assistant.

08

Promotions and referrals

  • Promo codes and referral rewards follow the terms shown with each offer. Unless an offer says otherwise: one account per person, no self-referrals, rewards have no cash value until credited to an eligible payout, and they cannot be combined.
  • Refer-a-friend: you earn a $5 credit when a friend you refer signs up, and a $25 credit when that friend makes their first submission, up to the limit shown in your portal.
  • We may refuse, reverse or cancel a reward obtained through fraud, duplicate accounts or abuse, and may change or end a program at any time without affecting rewards already earned.
  • Rewards may count as taxable income to you.
09

Partner submissions

Some businesses ("Partners") can submit items to us on behalf of their customers. If a Partner submits for you, you authorize that Partner to send your items and see the status of that submission. Your consignment with QC is still governed by these Terms and the Membership Agreement. A separate Partner Agreement governs the Partner's own obligations to QC.

10

Acceptable use

  • Do not bid on your own items, directly or through other accounts, or ask others to.
  • Do not try to access another person's account or data, probe or disrupt our systems, scrape the site, or use the Services for anything unlawful.
  • Do not submit stolen, counterfeit or altered items.
11

Photos and content

We own the photos and listing content we create. You allow us to use photos and descriptions of your items for listings, marketing and promotion, as stated in the Membership Agreement. Our name, logos and website content belong to us.

12

Disclaimers

We provide the Services "as is" and "as available." We do not promise any particular sale price, sell-through rate, or that the Services will always be available or error-free. Sale results depend on the market and on eBay, which we do not control.

13

Limitation of liability

To the fullest extent the law allows, QC is not liable for indirect, incidental, special or consequential damages, or lost profits. QC's total liability for any claim is limited to the fair market value of the affected item(s), as described in "Your items in our care," or, for claims not about a specific item, the fees QC earned from you in the 12 months before the claim.

14

Indemnity

You agree to cover our losses, including reasonable legal fees, from claims that an item you consigned was not yours to sell, was not authentic, was misdescribed by you, or from your breach of these Terms.

15

Disputes and governing law

Please contact us first at support@quickconsigncards.com — most issues are resolved quickly.

These Terms are governed by the laws of the Commonwealth of Pennsylvania. Any dispute will be handled in the state or federal courts located in Lackawanna County, Pennsylvania, except that either party may bring a claim in small claims court.

16

Ending your account

You can close your account by contacting us; items already live on eBay will finish selling and be paid out. We may suspend or close accounts for breaking these Terms, the Membership Agreement, or the law. Sections that by their nature should survive (payments owed, indemnity, liability limits, disputes) survive closing.

17

Changes to these Terms

We may update these Terms. If a change is material, we will tell you by email or in the portal at least 14 days before it takes effect. Continuing to use the Services after that means you accept the change. Changes do not apply retroactively to items already sold.
